BPF Moving Stage - Filter only active records

I have a Business Process Flow that goes from account to a membership record. This is to handle renewals.

The overarching process takes a membership record, copies the details and moves the date on 1 year, then deactivates the old membership record.

My issue is, when the renewal BPF goes from account I can see all of the old inactive membership records. As the membership number is the 'name' of the record this is the same for all old membership records. Can I filter so only the active membership records can be selected?
